1.  Agreement

By booking a tour with Titonwan Tours LLC, guests acknowledge that they have read, understood, and agree to these Terms & Conditions.

 

2.  Reservations and Payment

​

Full payment is required at the time of booking unless otherwise agreed in writing.

Reservations are not confirmed until payment has been successfully processed.

 

3.  Cancellation Policy

​​

• Cancellations made 14 or more days before the scheduled tour date will receive a full refund less any non-refundable payment processing fees.

• Cancellations made 7–13 days before the scheduled tour date will receive a 50% refund.

• Cancellations made fewer than 7 days before the scheduled tour date are non-refundable.

• No-shows are non-refundable.

 

4.  Weather and Operator Cancellation

Titonwan Tours reserves the right to cancel, modify, or reschedule tours due to severe weather, road conditions, safety concerns, vehicle issues, or circumstances beyond our control.

If Titonwan Tours cancels a tour, guests may choose either:

• A full refund, or

• Rescheduling to a future available date.

 

5.  Guest Responsibilities

 

Guests agree to:

• Arrive at the designated meeting location on time.

• Follow all safety instructions provided by the guide.

• Treat fellow guests, guides, and locations with respect.

• Comply with all applicable laws and regulations.

Titonwan Tours reserves the right to remove any guest whose behavior creates a safety concern or significantly disrupts the tour experience. No refund will be issued in such cases.

 

6.  Assumption of Risk

 

Tours may involve walking on uneven terrain, exposure to changing weather conditions, vehicle travel, and other inherent outdoor risks.

Guests voluntarily assume all risks associated with participation.

 

7.  Limitation of Liability

 

To the maximum extent permitted by law, Titonwan Tours LLC shall not be liable for personal injury, property loss, delays, interruptions, or other damages arising from participation in a tour, except where caused by gross negligence or willful misconduct.

 

8.  Photography and Media

 

Guests may take personal photographs during tours unless otherwise instructed at specific locations.

Titonwan Tours may photograph or record tours for promotional, educational, or archival purposes unless a guest requests otherwise in advance.

 

9.  Intellectual Property

 

All tour materials, written content, website content, branding, and educational materials remain the property of Titonwan Tours LLC and may not be reproduced without permission.

 

10.  Changes to Tours

 

Tour routes, schedules, stops, and itineraries may be modified when necessary due to weather, road conditions, site access restrictions, safety concerns, or operational needs.

 

11.  Governing Law

 

These Terms & Conditions shall be governed by the laws of the State of South Dakota.
